Interesting choice of phrase. While I have no doubt that many of the criminal elite consider themselves fortunate -- and why wouldn't they? They are not only successful but often untouchable. -- many criminals floating near the surface of the underworld (the scum) may feel that life has been unfair to them and that society is to blame. I doubt that such people would consider themselves fortunate.
