The 5th is based on the English Law of right to silence so I would guess y'all likely have something to similar effect. Might be closer to the UK version thought were juries are still allowed to judge and infer based on a plea of silence where here they are not.
I wonder if it would actually work that way? When a defendant could defend themselves but chooses to remain silent it sends a message that a jury may not realistically ignore. But a good answer, Glis. Thanks.
