'Tis a very bad time for this to happen.  His supreme lordship will now be able to keep his nefarious white grip on this nation - even after he's gone.

Yep. Ya know how that bast**d Mitch McConnell REFUSED to allow Obama to select a replacement for Scalia in 2016 saying no appointment should be made in an election year? Well the Dems are cramming that "McConnell rule" down his scrawny throat. What was good in 2016 to PREVENT Obama from doing what he was entitled to do BY LAW is gonna be the very same argument used to prevent Despot don from appointing a replacement to the Supremes until AFTER the November elections when we the people select the Senators we WANT who will then engage in ADVISE AND CONSENT. The bast**d man McConnell can't have it both ways. He has to play by his own phony fake contrived lie. Whatta a jacka** jerk he is. Well that chicken has come home to roost. His snarky smarmy snickers notwithstanding. SIGH. It's all about gamesmanship and cheating and changing the rules as you go along. Not about what is right and just and LEGAL. Thank you for your reply Shuhak and Happy Thursday!  :)

    One big difference....."Presidential" election year.
Obama appointed his last appointment in an midterm election year.

Personally ... I think the Supreme Court should be historians, not lawyers.
It is their job to rule on the Constitutionality of an issue ... and so they should be people who have studied the history of the Constitution and founding of the nation.

You know Walt all I would like is that they be NON-PARTISAN. I know that is a lot to ask but it's what I ask for. The appointees who are beholden to the president who installs them are worthless useless  bobblehead automatons. What we need is JUSTICE unfiltered through the lens of partisanship. I don't care if they are lawyers or doctors or schoolteachers. It would be very good if they were judges who were known for their excellent record of coming down on the side of what is RIGHT, FAIR, HELPFUL to we the people. But King don will lard the court with the extreme right-wing super partisan racist bigots. That is what his base wants because that is what they are.  Sadly. Thank you for your reply and Happy Thursday!

I'd love to see Congress occasionally exercise their authority to impeach federal judges.

But that's even more of a "pipe dream" than that they appoint non-partisan judges (no matter which party is in power).

I did not know Congress could DO THAT Walt! Not that this Congress plans to do anything about anything at any time any way. I thought all judges were supposed to be impartial/fair. Not so apparently. Thank you for your reply! :)

It's one of the "checks and balances" in the Constitution.
Though only 15 judges have ever been impeached - and only 8 of those convicted and removed (most recently, Judge Thomas Porteous of Louisiana in 2010).

    https://constitutionallawreporter.com/article-03-section-01/impeachment-of-federal-judges/

In fact, during Nixon v. United States, a district court judge was convicted of making false statements to a grand jury and was impeached. The Senate convened a committee to advise the full Senate on the matter, and the Senate followed the committee’s recommendation to remove the judge. The judge challenged this as unconstitutional, arguing that the full Senate had to sit and hear the evidence. The Court disagreed, dismissing the claim as a political question. The majority concluded that since impeachment is a political remedy, having the judiciary review the Senate’s decision and vote would endanger the separation of powers.

Only one justice has been impeached by the House of Representatives (Samuel Chase, March 1804), but he was acquitted in the Senate (March 1805).

  • Your indignation rings rather hollow. There are no NON PARTISAN justices or judges. The only  reason that we're even having this discussion is that the left wants a rubber stamp justice to approve their agenda.Sounds like activism to me. If you get anything other than a leftist nominee, we'll continue to hear the fable that there is some "conspiracy" to pack the court with what you term as right wing extremist bigots. The proof of intense political bias will come to light in the confirmation hearings ahead and it goes much farther than a choice between "loose" or "rigid" interpretation of the Constitution by a nominee. Acrimony, slander and hysterics will dominate these hearings. It's always the case. There'll be no room for character or integrity regardless of who the nominee happens to be. Again, there are NO NON PARTISAN judges and there will be no non partisan stances from either side of the aisle in Congress. Strangely, no one gives a damn about the court until it's time to replace a justice, then it's open warfare. We both know why.

And why there are no non-partisan judges ... because federal judges are appointed from the selection of lower judges, most of whom are elected.  And the only way to get elected is to have the funding of a political party.

  • In the dark and perverse reality of American Leftists, they have gone completely overboard in the blaming of some imaginary, bigoted Hobgoblins that they trot out on a regular basis to try and scare the populace as if we were all three year children. Save the Trick or Treat routine for October and get out of the way of real political and economic progress. We're here and we're here to stay. If you can't get with it, or get over it,  by all means get out of the way. Geez Louise, we all ought to be thankful for the bizarre rhetoric of the left cause it works wonders for stirring up the base. This post was edited by Benedict Arnold at June 30, 2018 3:32 PM MDT

I just heard....I am quite happy.
But do think it may rally more Dems to vote in November if they drag it out that long.

    But yay yay yay.
