PREMEDITATED MURDER. If a vic screams "I can't breathe I can't breathe" and the perp keeps choking how is that not premeditated?

How far in advance do you have to PREMEDITATE? Days, hours, minutes? How about when someone is telling you he can't breathe? How many times does that message have to be relayed?  Shouldn't ONCE have stopped the perp from continuing to hold the ILLEGAL CHOKEHOLD? "Heat of the moment" excuse? "I feared for my life excuse"? Seriously?

    If you did it as the act took place it is not premeditated. You have to plan it before the act for it to be premeditated. (Pre-planned)
