I'm not sure how they judge culpability in this instance because it depends on WHY someone is doing this.
Are they hiding something? That can become glaringly obvious real quick. Then there may be probable cause to seek punishment, but if the party has a good defense attorney for example, the reason for the pleading of the 5th may be simply because the Prosecutor did not allow the defendant to explain anything and the Prosecution merely wanted the Defendant to answer 'yes' or 'no' without any explanation, that will likely make appear guilty.
So, if you plead the 5th, you'd better have something to back your reasons besides just trying to hide your guilt. It will probably be exposed sooner or later.
Thank you for your thoughtful reply Sharon. It's really confusing. The 5th is supposed to protect you from incriminating yourself but if you elect to take it and get jailed what did you gain except not admitting something or not finking on someone? :)
