  • Hello excon... That is a really good question.

    It's my opinion that in a stand-your-ground situation, the original provocateur would be the one who is in violation of the law.

    Someone has to be the original provocateur.

    Why is it a good question.  One person is allowed to defend himself against an attacker.  Never are both allowed to stand their ground.  This is hogwash.

    If it's nonsense, why do you feel the need to respond??  I don't respond to nonsense..  I pass it by..  Plus, you went out of your way to be RUDE, and WRONG at the same time..  You got a twofer. 

    The problem with stand your ground, is that guilt or innocence TURNS on what's in a persons MIND - NOT in what he did..  All he need do is FEAR for his life, and he can SHOOT. So, WHY is only the 1st guy allowed to say he feared for his life???  Why couldn't the 2nd guy fear for his life too?

    I'll wait.

    PS>  (edited) I know..  Your thinking is confined to an attacker and the poor homeowner..  But, try to expand your thinking.  Consider two armed men in a bar.  Guy 1 hits guy 2.  Guy 2, fearing for his life, draws his gun.  Guy 1, fearing the same, draws his too, and shoots..  

    Whose ground was who standing?

    Oh, I agree.  In the context of chivalry and honor, it isn't the same..  But, in today's world when you've got two guys pointing their guns at each other, and BOTH of them think they're RIGHT and/or fear for their life, that's EXACTLY the same as a duel..

    A duel is when someone challenges the other to a duel for what ever reason and you both agree. Usually with witnesses.

      any other case such as the bar scene the person shot the other in self defense. In a civilized world your first option should be to call the police if you can but you do have the right to protect yourself.

    When I saw your question, Excon, I wondered if it was about the Governor of the State of Maine, but I see it isn't. All I can say in answer is that once again, I am glad I live in a country that has gun control, instead of that "right to bear arms" crap. I may be a bore on the subject, but if anyone wanted to turn our streets into a bloodbath, they would have to get through me and a lot of other angry Brits first.
