Just as with life/health of the Mother most states have an exception for rape/incest.

The person who is punished for the abortion is not the woman. But the Dr/clinic which performs the illegal abortion.

Only about 3% of abortions are for these reasons. This post was edited by my2cents at May 5, 2022 6:19 PM MDT

I already knew that. I'm still wondering about the penalty for performing one.

I'd guess it would be like all laws. There be max and min penalties, with the judge able to decide or a case by case basis and it would vary from one state to another.

It seems such a retrograde step to me -- very, very sad. But I expect that eventually the tide will turn back in favour of legal abortion, once the conservatives discover the steep rise in deaths from suicides and backyard abortions.

That will vary from state to state.

In my state, it would mean up to 30yrs in prison for the person performing the illegal abortion.

Penalty for rape in my state is up to life in prison.   This post was edited by my2cents at May 8, 2022 8:50 AM MDT

The punishment for rape should be castration. With a blunt, rusty knife. No anaesthetic.
