Is fraudulent speech protected by the first amendment? Can you lie your a** off without being punished for it? If so how fair is that?

  • Grey area.   Under oath before a court?  Never.
    In public, kinda.  There is no real laws against telling lies. Only telling lies in certain circumstances.  
    The real issue either way is proving a lie.  A false statement isn't proof of a lie.  It's circumstantial evidence of one, but that's it.  To prove a false claim is a lie one has to prove that person made said claim while knowing it not to be true.

    Yes..  By itself, lying is legal..  Lying to STEAL something or CHEAT somebody or DEFAME them isn't.
