Should law dictate wages be set per job description or should market place allow YOU to be paid what YOU accept?

Gender wage inequality in a nutshell? I know there are cases when two people with the same job are offered different salaries. It is unethical if not immoral but when all things are judicated do we create as many problems as we solve?
