    Defending a lawsuit is an expensive proposition and if you're going up against someone who has a lot of money and you don't, you can go bankrupt standing on your principles.  This is why so many lawsuits are settled short of trial.  Sometimes, it's the more practical decision.  It may not seem fair, but it certainly is realistic.
