Is baking protected speech? The Supremes are taking the Msterpiece Cake Shop vs Colorado Civil Righs Commission. Silly or serious?

For religious reasons the cake shop refused to bake a cake for  the wedding of a gay couple . The baker said his cake is art and is protected speech. In restaurents you sometimes see signs that  indicate they have a right to decide whom they will serve and whom they won't. Is that illegal? There are signs that read they don't serve folks who are barefoot and I guess in  fancy schmany dancy places if you are dressed appropriately the reserve the right to kick you out.  So where does reasonable and common sense fit it?
