Should John Kerry be charged under the Logan Act? Conducting US foreign policy without permission?

John Kerry spoke to the Palestinian leader and told him not to talk with the President about Israel. To wait until 2020 when perhaps a more simpathetic President was in power. The Logan Act forbids citizens from conducting foreign policy on their own.
