It depends upon the state. If you're in one of the civilized Northern States you could be charged with contempt of court. If it's in the South they won't do anything. In states like Alabama and Mississippi most of the white people are drunk after about 10am.
I would imagine they would send you home.
If the judge suspects you're drunk, he/she would probably order you tested and if it comes back over the legal limit, I suspect you would be arrested for drunk in public and put in the drunk tank for a few hours. Then when they felt you had sobered up and if you haven't caused any problems while you're there, they'd probably let you out and give you a court date to face the charges and possibly ordered to attend a certain number of AA meetings and be fined. I'm guessing mind you. I have no personal knowledge of what a court might do in that case.

Besides being dismissed, you could go to jail and probably will in most cities.
You get to go to the bathroom in front of a hundred or so inmates for 30 days. :-)
