Many restaurants or clubs state such policies. But can a patron be legally charged for drinks if he had none? Or can a patron refuse to pay and automatically added gratuity?

The only time a two drink minimum would be be required is if you wanted a bar set up for a private party, or it's the cost of entry into a club. If you understood the policy, that's a contract. In order to insure that its wait staff is compensated properly, they can demand an 18% gratuity on large party's or even individuals, if they so desire. If you order, it's a contract. Not only will you lose in civil court, in most jurisdictions, you can go to jail. Defrauding an innkeeper is a misdemeanor.
