How can the media claim the "Maryland Dad" did not have due process?

He was arrested in 2019 and denied bond by the judge.  
Garcia admits to illegal entry into the the US during 2012. 
The Maryland police issued a report saying he is a member of MS13. 
One immigration judge ruled he is a member of MS13. 
ICE ruled that he is a member of MS-13.  
A 2nd immigration judge ruled he is member of MS13. 
The man filed for asylum from jail.

The only mistake was he should have been deported to a detention center in either Mexico,  Nicaragua or Egypt.

His wife filed abuse charges in 2021
He was pulled of for speeding and reckless driving in 2022. And suspected of human trafficking.  8 others in the car with NO luggage at all and driving from TN to NY.  Biden admin said let him go. As there was a protection order not to be deported to El Salavador because of fear of retaliation from Barrio-18 the main rival gang of MS13.

Gang members are deportable.

    I admit I've not followed it all in a concise detailed way but it seems, to me, the little that I've read, that both "sides" have valid points.

    Hyattsville Police Department details 2019 encounter with Kilmar Abrego Garcia

    HYATTSVILLE, Md. (DC News Now) — In a news release published Monday, the City of Hyattsville Police Department (HPD) said that “at no time” did its officers identify Kilmar Armando Abrego Garcia as a member of any gang.

    HPD said that on March 28, 2019, a detective saw four men standing outside of a store in the 3300 block of East-West Highway. That detective saw them seem to hide something under a car, so he approached them.

    “During the encounter, the detective recognized one of the men as a known member of MS-13. This individual was not Abrego Garcia,” HPD said.

     
    The detective searched the men and found 28 grams of suspected marijuana on Abrego Garcia. HPD seized the suspected marijuana but did not file any criminal charges.

    “At no time did any member of the HPD identify or file any reports classifying Abrego Garcia as a member of any gang,” HPD’s statement read."

    Yeah but that detective was in the pocket of MS-13 and also sold fentanyl to school kids (that’s how the Trump team might try to discredit the officer anyway).
    Seems like no matter what info comes out that Garcia might not of been a MS-13 gang member – people will still believe he was and they will believe it because Trump tells them to. Also that officer and his family might soon be in danger because Trump will bad mouth him on Truth Social. Cheers!

    I don't think it would have been up to that detective to file charges.  That would have been up to the DA and, apparently, they didn't think there was sufficient evidence to convict him.

    EDITED TO ADD:  "Court records show he (the detective claiming Garcia was MS-13) was then indicted in June 2020 for misconduct in office. Court records allege he shared “sensitive and confidential information about an ongoing police investigation with a commercial sex worker.”  He pleaded guily to that charge and his employment was terminated.     There may have been more than one incident and more than one detective.  The fact that Garcia was never arrested (he has no rap sheet in either country) or indicted would indicate that there's some question whether or not he was a ganf member.

    I see.

    The one about the 2019 Hyattsville detective searching Garcia and only finding 28 grams of suspected marijuana – might point out that Garcia wasn’t MS-13. I figure if Garcia was MS-13 they would of found stuff like fentanyl on him. Cheers!

    Correct the HPD did not declare Garcia an MS13 gang member. 
    It was the Prince George County Police Department.  

    Which was then affirmed by immigration Judge 1, then Immigrantio Board then Immigrant Judge 2....etc.
