During the 80's, we thought crack cocaine was much more dangerous than powdered cocaine. So, we made the sentences for having/selling crack 100 TIMES harder than they would be for the same amount of powdered cocaine.. It was also true that black cocaine users preferred crack over powder..
Then we found out we were WRONG, and racist too, for that matter..
In recognition of our error congress reduced the sentencing disparity from 100 to 1, down to 18 to 1. Which, of course, made NO sense whatsoever... If there's NO difference, then there's NO difference.. Plus, they DIDN'T make it retroactive, so if you happen to have gotten caught during ONE set of sentencing laws, and NOT the other, too bad for you.
So, Obama has been pardoning people who WOULD already have been released IF they had been sentenced under the new guidelines.. He needs to get busy and pardon them ALL..
