I think spitting at someone should carry an automatic assault sentence and jail time or a fine should automatically be attached.

Spitting is a lethal weapon in many instances.

    Spitting at someone is assault here in NYC.  They told me I could have had my neighbor arrested when it happened the first time, but I was so stunned that anyone would do that, I just stood there like a stone monument.

    Spitting at someone is assault if the intended recipient is aware of it  and an attempted battery regardless; spitting on someone is battery unless the recipient didn't mind getting spat upon.  All three are misdemeanors and in most jurisdictions  could land one locked up for up to a year.  Fines as well.  Both assault and battery are also intentional torts which means a victim could also file a lawsuit, and according to the details of the case, might justify adding on an outrageous conduct count. 

    The moral of the story is don't spit at or upon someone intentionally.
