Actions are always mitigated by intentions/intellect. What if it's a mental midget doing it? Does IQ count?
If the colluder has an IQ of 90 is he as responsible for what he is doing as someone whose IQ is 150? Doesn't intelligence or severe lack thereof count here? Should it?
