I was talking to a lawyer friend of mine about discrimination. He said he's won some cases that he was sure he would lose, and he has lost some cases that he thought he would win.
Personally I'm not going to read the ADA to figure out if it is discrimination.
Fortunately, I am allowed to discriminate against any pool who has employed or has been forced to employ such a disabled lifeguard by simply swimming somewhere else.
And there is no penalty for me if I so choose to discriminate.
