Asparagus, beets and kidney beans, canned is okay. Tomatoes are a fruit so they don't count. Everything else, fresh or frozen. With Spinach or silverbeet, grow your own and cook it immediately - those are inedible an hour after being culled.
Yes. In our area they have winter farmers markets as well with over-wintered or stored root vegetables and greenhouse-grown greens and some other vegetables. And cheese and meat and fish and pickles and herbs. As well as prepared foods.
