    The use of the item decides if a tool or weapon.

      Not entirely.  Certain items are definitely weapons, are intended to be weapons, and/or are readily identifiable as weapons.  Also, almost any item that is not an actual weapon can be used as a weapon, or a person can claim it is a weapon.  Figurative things such as words can be weapons too.
