Depends on (1) if they targeted civilians, and (2) if there is an interstellar version of the Geneva Conventions.
If they have evidence (2) is yes ... they would be held according to those terms. Even though we haven't signed it, it would show good faith that we want any of our people treated to the same terms.
If (2) is no and (1) is yes ... they would be executed.
If both are no ... they would be held as a prisoner of war under the Geneva Conventions.
--- Of course, the chances of aliens attacking us is practically zero. It would be much simpler for them to get resources from asteroids and uninhabited planets. And if they have the technology to travel between planets, they probably don't need slaves.
One of the best books I've read (and My Number One Favorite Title to a Book) - - "The Midwich Cuckoos" by John Wyndham - - this book inspired a movie that terrified a young WelbyQ -- the original 1960 black-and-white "Village of the Damned."
I saw the movie, it scared me witless - and then I went to the library to get the book, ha. Wyndham's scifi stuff is flawless to me. :)
