If Birthright-citizenship is ended, what will determine citizenship?



If a baby is born in the US, How will it become a Citizen?
Does one of the parents need to be a Citizen? Which one?
Should EVERYONE born in the US NOT be automatically be a US citizen?
Should Citizenship be granted to people who are only here legally?
What if a couple is here with a legal Tourist visa and they have a baby here?

If the idea of ending Birth-Right Citizenship is being floated, the propopnents of the damn thing had better put on their thinking hats for this one...

  • Get shipped back to the parents' country of origin, grow up, and apply to come into the country legally.  There is a legal path.  Being born here to non-citizens doesn't make a kid a citizen any more than if I were to go to another country, have a kid born, and declare the kid, or myself, a citizen of that country.

    If one parent does not have citizenship, but the other does that mean the child is not a citizen?

    Right now, the Birthright citizenship is the legal path so it is legal so Yes...Being born here to non-citizens does make a kid a citizen

  • One parent being legal should qualify child as a citizen.  If one parent is illegal, though, said parent should marry the legal parent or be deported.

    Marriage is irrelevant and is not a determinant to a childs legitimacy. I think I saw somewhere that you said you were a Libertarian. Libertarians do not believe that a Marriage has to be sanctioned by the governement through a piece of paper

    I was not aware Obama and the Democrats were responsible for the 1898 ruling by the SCOTUS that said any child born in the US ... even to foreign citizens ... was an American citizen.

    But while we are at it, let's end this dual citizenship. No more Israeli-US citizenship. 
    You are either a Israeli citizen or a US citizen; you cannot be both simultaneosly.
    That is conflict of interest.

    Anyone who pledges allegiance to a foreign flag should have their US citizenship stripped immediately and be

    I know you and I disagree in our interpretations of the relevant clause in the 14th amendment, so lets take that off the table and take the assumption that there is no 14th amendment and the issue is not governed by any precedent, so this is about idea and not law.
    I would take the position in choosing immigration policy that a child born here, who is born to people who are citizens of a different country and are not legal residents or citizens here, would not be granted automatic citizen here, that child would be a citizen of their parents country.
    If a child is born to U.S. citizens while they were on vacation is in a foreign country, that child would be a U.S. citizen.
    Should at least 1 parent be a citizen?....Yes
    Should EVERYONE born in the US NOT be automatically be a US citizen?...No, if you are born here to a parent is a citizen, yes..
    Should Citizenship be granted to people who are only here legally?,,,again, as long as 1 parent is
    What if a couple is here with a legal Tourist visa and they have a baby here?...No, Legal residency is not established..

    Why should that baby be a citizen?

    I disagree with anyone here and I would fight with my life to defend the proposition that if a woman of another country stops, squats and drops a baby on US soil that child is now and forever a US citizen.

    I will never accept anything less and defend that notion to the death.

    If we took the 14th Amendment off the table ... the precedent would be the practices of the various states prior to 1868, regarding citizenship.
    In fact, prior to the 14th Amendment, citizenship was only granted by the states.  Not the federal government.

    EDIT:
    From what I can find, many states "citizenship" was based on active participation in government.
    Which would be interesting, in modern times.
    You either volunteer, hold office, participate in government meetings, or at least vote ... or you aren't granted citizenship.
    (just being employed by the government would not count)

    I have had the discussion with Judas before on birthright citizenship and it has been limited to or interpretations of the 14th amendment, and that is where it has ended. I simply wanted to get beyond the legal or constitutional merits, and into the details of it

    The citizenship of the parents. The child is a citizen if one of the parents is a citizen. 

    No anchor babies. 
    No birth tourism.

    It does not answer any questions at all.

    Trump and his Migrant wife (who's own imigration status is questionable) should be bver careful wtih this. They themselves may be very well be guilty of the very thing he claims should be illegal...

    What does it mean?
    Simple if one of the parents are not a citizen....then the child is not a citizen.

    Anchor baby....child of an illegal. The illegal will not be deported because the child is a citizen. 

    Birth tourism....when a mother from another country purposely travels to the US so her child can be born in the US and be a citizen. Helps them later on with college tuition etc.
