I don't mean the instances (which are infrequent, but do happen) where courts strike down some elements of legislation because of a separation of powers issue (I believe the Obamacare bill had a couple of those).
I mean the broader public invocation of "state's rights" on domains of policy. I can't think of one that, stripped of rhetoric, doesn't amount to "We want to discriminate against Group X, and the dang federal government won't let us. States' rights!" Is there one that doesn't fall into that category? Anyone? less
